Without limitation, you are not permitted to do any of the following without prior written permission from The Company (and may not allow a third party to do any of the same):
    1. Search and retrieve any information from The Company's computer systems using automatic querying, harvesting, crawling, scraping or any similar technique or program;
    2. Copy, reproduce, recompile, decompile, disassemble, reverse engineer, distribute, publish, display, perform, modify, upload to, create derivative works from, transmit or in any way exploit any part of the Site, except that you may download material from the Site and/or make print copies for personal use, provided that all copies utilised in this fashion retain all copyright and other proprietary notices;
    3. Modify the Site's content in any way, other than that which your membership permits;
    4. Use any names or trademarks included on the Site in any way that creates the idea that such names or trademarks belong to or are associated with you;
    5. Remove the copyright or the trademark notice from any copies of h-g-r Content made under these terms and conditions;
    6. Create a database in an electronic or a manual form by systematically and/or regularly downloading or printing or storing all or any of the h-g-r Content;
    7. Use any machine, electronic, web based or similar device to read or extract any of the h-g-r Content by an automated or machine-based means.
  8. Curriculum Vitaes (CVs) To assist you in the process of finding or applying to jobs, The Site gives you the option of submitting your CV within our database. Please take note that we utilise our best efforts to grant access to our CV database only to paying employers, but we cannot wholly guarantee that other parties will not, without our consent, gain access to our CV database. You have the option to let your CV expire from our database in time, or request your CV to be removed manually by The Company, but you should know that anyone (authorized or unauthorized) who has had access to our database may potentially have retained a copy of your CV. Please note that we are not responsible for the retention, use, or privacy of CVs in these instances, or for the use or privacy of CVs by any of such parties while CVs are in our database.
  9. Rights Reserved All present and future rights in and to trade secrets, patents, copyrights, trade names, trademarks, service marks, databases, intellectual processes, material and know-how, and other proprietary rights of any type under the laws of any governmental authority, including rights in and to all applications and registrations appearing on or relating to the Site shall, as between you and The Company, at all times be and remain the sole and exclusive property of The Company.
  10. Feedback The Company will always welcome your feedback, but please note that our policy does not permit us legally to accept submissions other than those which we have specifically requested. If, despite our request, you send us submissions, the submission shall be retained as the property of The Company.
  11. Intellectual Property You acknowledge that the Site has been created, prepared, revised, and arranged by The Company through the application of methods and standards of intellectual and experienced judgment requiring substantial time, effort and capital and constitutes the valuable intellectual property of The Company. The Site, including but not limited to text, content, photographs, video, audio and graphics, is protected by copyrights, trademarks, service marks, international treaties and/or other proprietary rights and laws of Switzerland and other countries. All individual elements making up the Site are copyrighted works and the Site is protected as a collective work or compilation under Swiss copyright and other laws and treaties. You acknowledge that you have no ownership rights in or to any proprietary rights and agree to abide by all applicable copyright and other laws in regard to the contents of the Site.
  12. Membership and User Password You are solely responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify The Company of any unauthorized use of your registration or password. You agree that contravening this clause can result in termination of your subscription, as per the best and final judgment of The Company.
  13. Disclaimer of Warranty and Limitation of Liability
    1. You agree that your use of the Site is at your sole risk and acknowledge that the Site and anything contained therein, are provided "as seen and accepted" and that The Company excludes all warranties, express or implied relating to the Site. This includes, but is not limited to, any implied warranty that the information it contains is accurate or up-to-date or is suitable for any particular purpose. The Company shall not be liable for any loss or damage suffered as the result of the use of this Site.
    2. Your use of assistance and advice given by the management and employees of The Company shall be solely at your own risk.
    3. The Site is only a venue and The Company does not screen or censor by policy all of the job postings offered, and does not guarantee control over the jobs or CVs posted, the truth or accuracy of the job postings.
    4. The Company does not confirm that each user is who he or she claims to be.
    5. You acknowledge and agree that you are solely responsible for the entire form, content and accuracy of any CV placed by you on the Site and agree that the specific employers that post job postings, not The Company, are solely responsible for their postings on the Site.
    6. The Company does not warrant that the Site will operate error-free, although every effort will be made to ensure that it does.
    7. In no event shall The Company be liable in any way for any damages resulting from the use or inability to use the Site.
  14. Indemnification You absolutely agree to defend, indemnify, and hold harmless The Company, its offices, directors, employees and associates, from and against any claims, actions or demands, to the extent based on or arising in connection with your use of the Site. You agree to pay any and all costs, damages and expenses, including without limitation reasonable legal and accounting fees, awarded against or incurred by or in connection with or arising from any such claim, suit, action or proceeding.
  15. Termination of Site Use
    1. You agree that The Company, in its sole discretion, may immediately terminate your password, account (or any part thereof) or use of the Site, and remove and discard any content within the Site, for any reason, including, without limitation, if The Company believes that you have violated or acted inconsistently with the letter or spirit of the Terms. The Company may also in its sole discretion and at any time discontinue providing the Site, or any part thereof, with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that The Company may immediately deactivate or delete your account and all related information and files in your account and/or prohibit any further access to such files or the Site. Further, you agree that The Company shall not be liable to you or any third-party for any termination of your access to the Site. Upon termination, you agree to promptly destroy all materials obtained from the Site and any copies thereof.
    2. You have the right to terminate this Agreement by discontinuing your use of the Site and destroying all materials obtained from the Site.

  16. Links to Other Sites The Company cannot be held responsible in any way for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites.
  17. Eligibility
    1. The Site is not designed to be used by any person under sixteen (16) years of age. By submitting any personal information, you represent, warrant and covenant that you are at least sixteen (16) years old. Anyone sixteen (16) years of age or under may visit the Site as a guest, but should under no circumstances submit or post to the Site any personal information. The Company is not responsible in any way for employers that try or choose to employ applicants of less than the legal working age within their locality.
    2. The Site is designed to be used by current hospitality students and/or recent hospitality alumni. Recent alumni is defined as any person who has graduated within the last 10 years.
  18. Miscellaneous
    1. Other areas of the Site may be subject to additional terms of use. You agree to be bound by these additional terms of use as appropriate.
    2. You acknowledge that The Company has the right to change the content or technical specifications of the Site in any way and at any time at The Company's sole discretion. You further accept that such changes may result in your being unable to access the Site.
    3. These Terms shall be governed and construed in accordance with the laws of Switzerland, without giving effect to conflicts-of-law principles thereof. You agree to submit to the personal jurisdiction of Swiss law, with respect to any legal proceedings arising out of this agreement or your use of the Site and waive any objection to the propriety or convenience of venue in such courts within Switzerland.
